Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of the Pixift platform ("Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
2. Definitions
"Platform": All Pixift services including the pixift.com website, desktop application, and mobile application. "User": Any natural or legal person who has registered on the Platform. "Services": Commission calculation, price analysis, listing management, market data retrieval, and all other Platform features. "Marketplace": Third-party gaming marketplaces.
3. Services
Pixift is a SaaS platform designed for sellers operating on gaming marketplaces. The Platform offers commission calculation, withdrawal optimization, market analysis, listing management, and order processing services. The scope of services may vary depending on your subscription plan.
4. Accounts and Registration
Access to the Platform requires signing in with Google OAuth. You are responsible for the security of your account and all activities that occur under it. You must notify us immediately if you become aware of any unauthorized access to your account. Each user may create only one account.
5. User Obligations
You agree to use the Platform only for lawful purposes. You may not misuse the Platform, attempt reverse engineering, circumvent security measures, or interfere with other users' access to the services. You must use your marketplace credentials and cookies only for your own accounts. You are solely responsible for compliance with the terms of service of third-party marketplaces.
6. Subscriptions and Payment
The Platform offers two subscription plans: Starter and Pro. Payments are processed through a secure payment provider. Subscriptions renew automatically and can be cancelled at any time. Upon cancellation, service continues until the end of the current billing period. Refund policy is subject to the payment provider's general terms. Prices may be changed with prior notice.
7. Intellectual Property
All intellectual property rights including source code, design, logos, and content belong to Pixift. Users are granted a limited, revocable, non-exclusive license to use the Platform for personal and commercial purposes. Copying, distributing, or creating derivative works from any part of the Platform is prohibited.
8. Third-Party Services
The Platform integrates with third-party services for authentication, payment processing, and marketplace data integration. The availability and terms of these services are controlled by their respective providers. Pixift cannot be held responsible for disruptions in third-party services.
9. Disclaimer of Warranties
The Platform is provided "as is" and "as available." Pixift makes no express or implied warranties regarding the service being uninterrupted, error-free, or secure. The accuracy, timeliness, or completeness of marketplace data is not guaranteed. Compatibility of third-party platform integrations may change over time.
10. Limitation of Liability
Pixift shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Platform. This limitation covers data loss, loss of profits, business interruption, or issues related to your marketplace accounts. Pixift's total liability is limited to the subscription fees paid in the last 12 months.
11. Account Termination
You may close your account at any time. Pixift may suspend or terminate your account with or without prior notice in the event of a violation of these Terms. Upon account termination, your data on the Platform will be deleted within a reasonable period.
12. Changes to Terms
We reserve the right to update these Terms from time to time. Significant changes will be communicated through the Platform or via email. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of Turkey. The courts and enforcement offices of Istanbul shall have exclusive jurisdiction for the resolution of disputes. For users in the European Union, this does not affect your rights under the applicable consumer protection laws of your country of residence.
